Definitions

Schipholtaxi.Amsterdam is part of the Internet Taxi Centrale (I.T.C.).

Schipholtaxi.Amsterdam: Schipholtaxi.Amsterdam is an internet-based service platform. It aims to connect supply and demand in the Schiphol taxi market.

Schipholtaxi.Amsterdam: A website where consumers and businesses can book a taxi online at a fixed price.

Taxi Company: Taxi companies that participate on the Schipholtaxi.Amsterdam platform and are evaluated for reliability by service buyers on Schipholtaxi.Amsterdam.

User: Consumers and businesses who can book a taxi online at a fixed price.

2.1 Use of Schipholtaxi.Amsterdam

  • It is expressly forbidden to use Schipholtaxi.Amsterdam in any manner other than as described on the Schipholtaxi.Amsterdam website.
  • he user is responsible for ensuring that the description of the taxi ride booked by them accurately reflects reality and is therefore correct and complete.
  • The taxi company is responsible for ensuring that the description of the service offered by them accurately reflects reality and is therefore correct and complete. Schipholtaxi.Amsterdam is not responsible for the actions or the products and services offered by taxi companies, nor for the quality, safety, or legality of these products or services.

2.2 Intellectual Property

  • The intellectual property rights related to the Schipholtaxi.Amsterdam websites, including texts, images, layout, photos, visual and/or audio material, formats, software, trademarks, and domain names, rest with Schipholtaxi.Amsterdam or its licensors or taxi companies.
  • Third parties are prohibited from reproducing or making Schipholtaxi.Amsterdam available to others, except for downloading and viewing Schipholtaxi.Amsterdam for private, personal use.

2.3 Closing Ride Orders/Cancellations

  • If the traveler has ordered a taxi via the website or by phone, by entering/providing the postal code, house number, and number of persons, and subsequently filling in the remaining details and submitting the form, the request is final, and the ride(s) will be scheduled and executed.
  • If the traveler has not received an overview and/or confirmation by email, they should immediately contact Schipholtaxi.Amsterdam to verify the order and email address.
  • The traveler/client is entitled to cancel the previously concluded transport agreement with the agreed fare exclusively via email, after which they will receive confirmation. A cancellation is only valid if it has been received and/or confirmed on time by Schipholtaxi.Amsterdam.
  • Free cancellation: If the cancellation occurs more than 12 hours before the start of transportation, the traveler/client owes nothing to the carrier.
  • Cancellation within 12 hours: If the cancellation occurs within 12 hours before the start of transportation, the traveler/client is liable for the full agreed fare to the carrier.

2.4 Disputes

  • Any dispute between the buyer and the taxi company concerning the (potential) agreement must be resolved by the taxi company. Schipholtaxi.Amsterdam is expressly not a party to this dispute.
  • Schipholtaxi.Amsterdam reserves the right to exclude an account if there are payment disputes between the taxi company and buyer(s) and/or there are negative reviews about the reliability of the taxi company or user.

2.5 References

  • Schipholtaxi.Amsterdam contains references to third-party websites. Schipholtaxi.Amsterdam has no control over these websites and is not responsible for their content. The general terms and conditions of those sites apply when using these websites, unless explicitly agreed otherwise.

2.6 Security

  • Schipholtaxi.Amsterdam will make reasonable efforts to secure its systems against loss and/or unauthorized use and will take appropriate technical and organizational measures, considering the state of the art.

2.7 Liability

  • Schipholtaxi.Amsterdam excludes any liability for any damages, whether direct and/or indirect, arising in any way from and/or resulting from the use of Schipholtaxi.Amsterdam.
  • Schipholtaxi.Amsterdam is under no circumstances liable for any damages resulting from actions by third parties, the inability to use Schipholtaxi.Amsterdam, unauthorized use of Schipholtaxi.Amsterdam by a third party, and actions of third parties after a ride order has been established via Schipholtaxi.Amsterdam, whether online or by phone.
  • The liability limitations in these general terms and conditions for direct and/or indirect damage do not apply if the damage is due to intent or gross negligence by Schipholtaxi.Amsterdam or its employees.
  • Schipholtaxi.Amsterdam is not obliged to fulfill one or more obligations if it is prevented from doing so due to force majeure.
  • Schipholtaxi.Amsterdam cannot be held liable for delays, changes, or cancellations of service due to force majeure or other unforeseen circumstances beyond the control of both Schipholtaxi.Amsterdam and/or the driver.
  • The liability of Schipholtaxi.Amsterdam for direct damage due to attributable shortcomings in the accurate, complete, and timely presentation of ride orders is limited to the amount charged for the service by Schipholtaxi.Amsterdam.
  • Schipholtaxi.Amsterdam is not liable for indirect damages, including but not limited to consequential damages such as parking fees, plane tickets, lost profits, missed savings, business interruption, or data loss.

2.8 Exclusion

  • Schipholtaxi.Amsterdam reserves the right to exclude anyone from using Schipholtaxi.Amsterdam if they act in any way that violates the law, public order, decency, these general terms and conditions, or if further legal action and/or compensation is deemed necessary.

2.9 Miscellaneous

  • If any provision of the general terms and conditions is declared null and void or is annulled, the other provisions of the general terms and conditions shall remain in force.
  • These general terms and conditions are governed by Dutch law. Any disputes will be submitted to the competent court in Utrecht.
  • These general terms and conditions may be amended by Schipholtaxi.Amsterdam at any time and are available on Schipholtaxi.Amsterdam. Amended general terms and conditions are effective immediately.
